The day of his accident, Rafael Cabrera thought and acted quickly: he went to the hospital and then sought the advice of the Ginarte law firm. These two steps made the difference so that he could file and win his case against the company he works for.
Almost two years ago he was tying pallets to the side of a truck, when one of the sides of the pulling belt was released, causing him to lose his balance and fall on his back on the hooks of the loading machine. “While falling, I instinctively moved to the left side so as not to injure my spine. In return, I stripped my entire arm and hit my neck, shoulder and elbow, ”Rafael recalls.
As soon as he could get up, Rafael went to inform his supervisor of the accident and asked to take him to the hospital. This, however, had him sitting for three hours in the office and indicated that he should go to the company doctor the next day. However, the strong pains forced Rafael to go directly to the hospital that same night, where they made different plans and reported his injuries.
“Despite the pain, the next day I returned to work, because I cannot afford to miss. The company doctor just did a drug test. Evidently he found nothing and said I could continue with the work normally. To top it off, on the day of the accident I was only paid for the three hours I worked. That is when I knew I had to find a lawyer to defend my rights and make the company pay me for the medical care my injuries needed,” Rafael recalls.
Upon hearing the details of the case, the Ginarte law firm immediately mobilized to defend Rafael’s rights, demanding workers compensation that would allowed Rafael to receive therapy and compensation for the damages suffered. “I recommend everyone who has an accident at work to go to the hospital first and then contact Ginarte’s lawyers. My experience was excellent. Not only did they always keep me up to date, but they explained the legal details in my language, which made the difference. I am very satisfied with the results,” he says.
