The U.S Occupational Safety and Health Administration has cited a New York crane company for safety violations in a crane collapse that killed a worker in Manhattan last April, according to a report on phillyburbs.com. The fines, totaling $68,000, were for safety violations that contributed to the collapse at a subway line extension site. Sadly, a 30-year-old worker Burlington City construction worker was fatally injured when the crane crumbled on top of him. The subcontractor that employed the worker also has been cited. [Read more…]
New York Fatal Crash Kills Four Teenagers
Four 18-year-olds were killed in West Hempstead, N.Y., on October 2012 when their car went out of control on a curve on the Southern State Parkway and crashed into a tree, according to an Associated Press report. $1,000,000 Awarded for Pain & Suffering due to Shoulder Injury
In Rubio v. New York City Transit Authority, the Appellate Division, First Department reduced a damages award of almost $2.5 million dollars to $1 million for pain and suffering due to a shoulder injury. Joseph Rubio was boarding a kneeling Transit Authority bus when the steps of the bus rose without warning, causing him to fall forward and hurt his shoulder. Of note, it was Rubio’s dominant shoulder which was later operated on to repair the subscapularis and supraspinatus. Rubio also sustained a post-operative infection at the surgical site. Rubio sued the Transit Authority alleging the bus driver was negligent in his operation of raising the kneeling bus while Rubio was still in the stairwell while boarding. Notably, Rubio did not report the accident to the police or Transit Authority, nor was an ambulance called to assist Rubio. Rubio also did not immediately seek medical attention; he went to work and only later went to see his doctor. Due to these misgivings, the Transit Authority argued that the accident never happened. Dog in Car May Have Contributed to Deadly Accident
Investigators believe that a dog loose in a car may have contributed to a recent crash that killed a married couple and injured three others on September 2012 as they were walking home from a religious service in New Brunswick, N.J. Investigators said the driver of a 1998 Toyota Avalon lost control of the vehicle, struck a utility pole and then hit the pedestrians. The driver’s pet dog was in the car at the time and may have been a factor in the accident, authorities said. [Read more…]

Passengers Injured When Toronto Tour Bus Overturns
A chartered bus overturned and slid down an embankment on a Route 80 exit ramp in northern New Jersey earlier this month, injuring 23 of its 57 passengers. The bus was on its way from Toronto to New York City; many on board were heading for a Seventh Day Adventists church event. Some of the windows in the bus burst during the crash, and some passengers were pinned in the frames before they were freed by rescue workers. [Read more…]

A woman walking along 58th Street was injured recently when she was struck by a construction truck and pinned beneath the vehicle until firefighters could extricate her. According to news reports, the accident took place at a construction site at 220 Central Park South. Mail Truck Trial in Fatal Bike Accident Begins in New York
The trial got under way recently for the driver of a mail truck that fatally injured Marilyn Dershowitz last year in Manhattan. If convicted of leaving the scene of a fatal accident, he could face up to seven years in prison under New York law. The charge stems from an accident on July 2, 2011, when Mrs. Dershowitz, who was the sister-in-law of well-known Harvard law professor and defense attorney Alan Dershowitz, and her husband made the fateful decision to stay home and be “tourists” in their own home city.
