On June 11, 2012, after a hard fought four day trial, Ginarte Law Firm obtained a $350,000 verdict on behalf of a Portuguese-speaking client who was injured in a New York car accident.
The case involved a 54 year-old woman who was struck by a car while crossing the street. She sustained injuries to her low back and right hip.
New Jersey Manufactures Insurance Company argued that the plaintiff was responsible for the accident alleging she darted out into the road from between two buses. However, Mr. Perez was able to present evidence to the jury that the defendant actually admitted that his vision was impaired immediately before the accident as a result of sun glare, and that our client was crossing the street legally within the crosswalk.
Additionally, New Jersey Manufactures Insurance Company argued that our client’s injuries were not permanent or caused by the accident. Therefore, New Jersey Manufactures refused to offer any money to our client to settle the claim. After the jury was presented with medical evidence, they were convinced that the plaintiff suffered permanent injuries as a result of the defendant’s negligence and awarded her $350,000, not including pre-judgment interest and other penalties.
