Essex County, NJ
The plaintiff driver, approximately 30, contended that she was struck in the rear by the defendant while stopped. The plaintiff maintained that she developed symptoms in the cervical, thoracic and lumbar areas shortly after the collision. The MRI showed herniation in the cervical and a bulge in the lumbar area. The plaintiff underwent injections. The plaintiff maintained that because of continuing severe lumbar complaints, her orthopedic surgeon ordered a discogram that revealed a herniation and not a mere bulge as well as a tear at an adjacent level that was not seen on the MRI. The plaintiff maintained that despite surgery, she will suffer extensive symptoms permanently.
The defendant maintained that any continuing difficulties stemmed from a 2000 collision that produced long term lumbar complaints.
The plaintiff made no income claims.
The case settled prior to trial for $150,000.
