This answer depends on several factors. Many defendants will have insurance policies that provide what is commonly referred to as “Med-Pay” or medical expense benefits. In this instance, it does not matter who is at fault for the accident. If the accident occurred on the defendant’s property, many times, this “Med-Pay” policy will provide some coverage for an injured party’s medical bills. If there is no “Med Pay” coverage, then to recoup your medical expenses from the defendant, one must prove fault against the defendant. Lastly, if you have your own insurance policy or enough money in savings, you can certainly pay for your medical expenses on your own and hope to recoup it through a lawsuit.
